We remind you that under current legislation, the construction of a residential building on land plots provided in the prescribed manner for the construction and maintenance of a residential building must be completed by a citizen within three years from the date of state registration of the right of private ownership, perpetual hereditary possession, or lease of such land plots.

A citizen has the right to extend the construction period, but by no more than two years, by applying to the district executive committee no earlier than six months and no later than two months before the expiry of the construction period. Also, in case of impossibility to complete construction within the established deadlines, the citizen is obliged to conserve the unfinished residential building; the term of such conservation cannot exceed three years. At the same time, the right to extend the established construction period, as well as the conservation of the residential building, can be exercised with respect to a specific construction object only once.

In accordance with the Law of the Republic of Belarus of July 5, 2004 No. 300-Z "On Architectural, Urban Planning and Construction Activities in the Republic of Belarus," completed construction objects are subject to commissioning. Commissioning of a residential building is allowed without the performance of certain types of work, if this is provided for by the approved design documentation, does not contradict the legislation, and does not impede the operation of the facility or the functioning of the engineering infrastructure.

In order to simplify the procedure for commissioning individual residential buildings and (or) non-residential capital structures of the fifth complexity class on the adjacent territory, Decree of the President of the Republic of Belarus No. 253 of July 25, 2022, was adopted. In accordance with this decree, until January 1, 2025, construction objects built (reconstructed) by citizens on land plots, the rights to which arose before September 1, 2022, and intended for the construction and maintenance of individual residential buildings, can be commissioned without the availability of permits for their construction (reconstruction) and (or) design documentation, and are not recognized as unauthorized construction.

The operation of a residential building by citizens without its proper commissioning or in violation of such commissioning procedure is an administrative offense and entails a fine ranging from two to ten basic units.
