What are the consequences for illegal actions concerning civilian UAVs and model aircraft?

We hereby inform you that the Law of the Republic of Belarus of October 20, 2025, No. 101-3 "On Amendments to Laws on Criminal and Administrative Liability" entered into force on November 2, 2025.

The Law establishes administrative liability for the illegal import, storage, circulation, operation, or manufacturing of unmanned aerial vehicles or model aircraft into the territory of Belarus. Criminal liability is incurred for similar actions committed repeatedly within one year after the imposition of an administrative penalty.

Article 300-1 of the Criminal Code "Illegal actions concerning civilian unmanned aerial vehicles and model aircraft"

The import into the territory of the Republic of Belarus, storage, circulation, operation, or manufacturing of civilian unmanned aerial vehicles or model aircraft in violation of the requirements of the legislation, committed within one year after the imposition of an administrative penalty for the same violations, shall be punishable by public works, or a fine, or correctional labor for up to one year, or arrest, or restriction of liberty for up to two years with or without a fine, or deprivation of liberty for the same term with or without a fine.

Article 18.35 of the Code of Administrative Offenses "Violation of air traffic rules"

1. Violation of air traffic rules, except for violations provided for in Part 2 of this Article, shall entail a fine of twenty to fifty basic units, for an individual entrepreneur – thirty to sixty basic units, and for a legal entity – forty to one hundred basic units.

2. Violation of air traffic rules using a civilian unmanned aerial vehicle, an ultralight aircraft, including a glider, hang glider, paraglider, or amateur-built aircraft, a balloon, or rules for the use of model aircraft shall entail a fine of five to fifty basic units with or without confiscation of the object of the administrative offense, for an individual entrepreneur – ten to one hundred basic units with or without confiscation of the object of the administrative offense, and for a legal entity – twenty to one hundred and fifty basic units with or without confiscation of the object of the administrative offense.

Article 18.38 of the Code of Administrative Offences "Illegal actions concerning civilian unmanned aerial vehicles and model aircraft"

1. The import into the territory of the Republic of Belarus, storage, circulation, operation or manufacture of civilian unmanned aerial vehicles or model aircraft in violation of the requirements of the legislation shall entail a fine of up to thirty basic units with confiscation of the subject of the administrative offense.

2. The import into the territory of the Republic of Belarus, storage, circulation or manufacture of civilian unmanned aerial vehicles or model aircraft by legal entities or individual entrepreneurs in violation of the requirements of the legislation shall entail a fine of up to fifty basic units with or without confiscation of the subject of the administrative offense, for an individual entrepreneur from thirty to one hundred basic units with or without confiscation of the subject of the administrative offense, and for a legal entity from fifty to two hundred basic units with or without confiscation of the subject of the administrative offense.
