The Ministry of Natural Resources and Environmental Protection has adopted a new resolution in the field of atmospheric air protection
The document approves:
1. The Regulation on the procedure for conducting an inventory of emissions of pollutants into the atmosphere;
2. The Regulation on the procedure for establishing standards for permissible emissions of pollutants into the atmosphere.
The first Regulation, in addition to the procedure for conducting emission inventories, defines the methods for its implementation, requirements for accounting for emission variability, and for the composition, design, and content of the inventory report.
According to the Regulation, emission inventories are conducted by legal entities and individual entrepreneurs who carry out economic and other activities related to the emission of pollutants into the atmosphere from stationary emission sources, in order to obtain initial data for:
- assessment of the technological processes and methods used for compliance with the requirements of regulatory legal acts, including mandatory technical regulatory legal acts;
- analysis of the compliance of atmospheric air pollutant emissions with the requirements of mandatory technical regulatory legal acts;
- assessment of the degree of compliance of the applied technological processes and methods of production of products and energy, execution of works (provision of services), gas purification technology, gas cleaning equipment with the best available techniques;
- establishment of standards (temporary standards) for permissible atmospheric air pollutant emissions.
Inventory is not carried out for mobile and non-stationary emission sources.
According to the Regulation on the Procedure for Establishing Standards for Permissible Atmospheric Air Pollutant Emissions, such standards are determined in permits for atmospheric air pollutant emissions and (or) integrated environmental permits issued in accordance with the legislation on administrative procedures.
The standards include the maximum mass of a pollutant emitted into the atmosphere per unit of time and the maximum permissible concentration of a pollutant emitted into the atmosphere.
The Regulation specifies that standards are not established for non-stationary and mobile emission sources, pollutant emission sources, and emission sources that are under conservation.
Resolution No. 33 also establishes the following lists:
- pollutants and aggregate pollutant indicators for which permissible emission standards for pollutants into the atmosphere are established;
- atmospheric impact objects for which permissible emission standards for pollutants into the atmosphere are established;
- atmospheric impact objects, emission sources, and types of activities for which permissible emission standards for pollutants into the atmosphere are not established.
In addition, a number of Ministry of Natural Resources and Environmental Protection resolutions are recognized as having lost force. These include:
- of May 29, 2009 No. 30 "On approval of the Instructions on the procedure for classifying objects affecting the atmospheric air into certain categories";
- of June 8, 2009 No. 37 "On approval of the Instructions on the procedure for developing technological standards for emissions of pollutants into the atmospheric air";
- of June 23, 2009 No. 42 "On approval of the Instructions on the procedure for inventorying emissions of pollutants into the atmospheric air";
- of October 19, 2020 No. 21 "On standards for permissible emissions of pollutants into the atmospheric air".
The legal act is adopted in accordance with the Law of the Republic of Belarus of December 16, 2008 No. 2-Z "On Environmental Protection of Atmospheric Air".
The resolution enters into force after its official publication and extends its effect to relations that arose from January 23, 2024.
