Approval of the inventory report of atmospheric air pollutant emissions

The regional committee draws attention to the fact that as of January 23, 2024, amendments to the Resolutions of the Council of Ministers of the Republic of Belarus dated 24.09.2021 No. 548 and dated 21.05.2009 No. 664, and amendments to the Resolution of the Ministry of Natural Resources and Environmental Protection of the Republic of Belarus dated 21.01.2022 No. 9 have entered into force, according to which the requirements for the administrative procedure p. 6.21.5 Obtaining a conclusion on the approval of the inventory of emissions of pollutants into the atmosphere.

The specified administrative procedure is carried out in relation to legal entities and individual entrepreneurs in cases where, according to the inventory of emissions of pollutants into the atmosphere, the total gross emissions of pollutants are 3 tons per year or less, or the gross emissions of pollutants of hazard class 1 are 10 kilograms per year or less.

We also draw attention to the fact that the applicant or their representative applies to the approval body for a new conclusion on the approval of the emissions inventory in cases of:

- reorganization of a legal entity in the form of merger, separation, division, or accession of another legal entity to it - within six months from the date of state registration of the legal entity or state registration of amendments and (or) additions made to the constituent documents of the legal entity;

- transfer of ownership, economic management, operational management of facilities affecting the atmosphere, lease or other legal basis for facilities affecting the atmosphere - within six months from the date of occurrence of such circumstances;

- the need to change the amount of emissions of pollutants into the atmosphere, including an increase in the amount of such emissions up to 3 tons per year inclusive or emissions of pollutants of hazard class 1 up to 10 kilograms per year inclusive, supplementing the emissions inventory with pollutants and (or) emission sources not previously indicated therein, from the date of occurrence of such circumstances.

The Regional Committee shall review the documents and/or information submitted by the applicant or their representative within ten days, verify their compliance with the requirements of the legislation on atmospheric air protection, and make a decision on issuing a conclusion on the approval of the emission inventory report or refusing to issue a conclusion on the approval of the emission inventory report.

A decision to refuse the applicant the issuance of a conclusion on the approval of the emission inventory report shall be made in cases provided for in Article 25 of the Law of the Republic of Belarus "On the Fundamentals of Administrative Procedures", as well as when facts of erroneous determination (calculation) of the amounts of emissions of pollutants into the atmosphere are established.
