Economic activity in the coastal strips of water bodies

If the declared land plot is located fully or partially within the coastal zone of a water body, which is also reflected in the Geoportal of Land Information Systems of UP "Belgiprozem Project Institute", then the regime of economic and other activities on this plot must be carried out in accordance with the requirements of Article 54 of the Water Code of the Republic of Belarus of April 30, 2014 No. 149-Z (hereinafter - the Water Code). The prohibitions and restrictions specified in Article 53 of the Water Code also apply.

It should be noted that for all categories of water bodies in the region, the sizes of the boundaries of water protection zones and coastal zones have been established, and the regime of economic activity has been determined in accordance with the requirements of the Water Code. Decisions of district and regional executive committees on the approval of projects for water protection zones and coastal zones have been adopted. All projects have undergone examination at the NCPi. In case of non-compliance with the requirements of the legislation, administrative liability is provided for under Part 2 of Article 16.34 of the Code of the Republic of Belarus on Administrative Offenses, a fine for an individual is up to 10 basic units, for an individual entrepreneur up to 25 basic units, for a legal entity up to 50 basic units.

Taking into account the above, we recommend contacting the land management department of the executive committee to obtain data on the actual boundaries of the coastal zone and water protection zone of water bodies at the location of the requested land plot. Also, when building a private house on a plot with restrictions on land use in water protection zones or coastal zones of water bodies, as well as when developing a project for the reconstruction of a capital structure and outbuildings on this land plot, the requirements of the current legislation must be strictly observed, taking into account Articles 53 and 54 of the Water Code, in order to avoid problematic issues during the approval of project documentation with the departments of architecture and construction of the district executive committee, and subsequently during the commissioning of the facility after the completion of construction.
