On the amendment of legislative requirements in the field of waste management
13.05.2026 the procedure for obtaining a conclusion on the possibility of destroying goods intended for customs clearance for destruction has been clarified.
In cases where foreign goods located on the territory of the Republic of Belarus lose their consumer properties, including not meeting the established safety requirements (i.e., they actually belong to the category of waste), they can be placed under the customs procedure of destruction.
Destruction of goods means bringing goods into a state where they are partially or completely destroyed, or lose their consumer and/or other properties and cannot be restored to their original state in an economically viable manner (paragraph 1 of Article 248 of the EAEU Customs Code).
By Resolution of the Ministry of Natural Resources and Environmental Protection of the Republic of Belarus dated 13.05.2026 No. 18, amendments were made to the Regulations on Administrative Procedures carried out in relation to business entities under sub-paragraph 6.35.1 "Obtaining a conclusion on the possibility of destroying goods intended for customs clearance for destruction", approved by Resolution of the Ministry of Natural Resources and Environmental Protection of the Republic of Belarus dated January 14, 2022 No. 5 "On Approval of the Regulations on Administrative Procedures."
Now, for the implementation of the administrative procedure, business entities (legal entities or individual entrepreneurs), in addition to an application and other documents, can submit copies of contracts for the use, disposal, and/or neutralization of waste generated as a result of the destruction of goods, with organizations operating waste use facilities, disposal facilities, and/or neutralization facilities, which may not be included in the register of waste use facilities and the register of storage, disposal, and neutralization facilities.
Documents for carrying out the administrative procedure are sent to the regional committees (at the place of goods destruction) in writing, as well as in electronic form through the unified portal of electronic services.
The timeframe for carrying out the administrative procedure is 5 working days.
