In accordance with Article 26 of the Law of the Republic of Belarus of December 30, 2011 No. 334-Z, the Law of the Republic of Belarus of October 14, 2022 No. 213-Z "On the Bar and Advocacy in the Republic of Belarus", lawyers provide clients with the following types of legal assistance:
- provide consultations and explanations on legal issues;
- prepare applications, complaints, and other legal documents;
- represent the interests of clients in courts, including at the stage of execution of court decisions, as well as in state bodies, other organizations, including their management bodies, and before individuals;
- participate in pre-trial proceedings and court proceedings in criminal cases as a defense counsel, as well as a representative of victims, civil plaintiffs, civil defendants;
- participate in administrative proceedings as a defense counsel, representative of a victim, other individuals or legal entities who are participants in administrative proceedings;
- conduct legal assessment of documents and activities;
- carry out legal work to ensure economic and other activities;
- carry out legal work on attracting investments to the Republic of Belarus;
- perform legally significant actions on behalf of and in the interests of clients within the scope of authority granted to them by the client and legislation;
- provide other types of legal assistance.
In accordance with Article 28 of the Law of the Republic of Belarus "On the Bar and Advocacy in the Republic of Belarus", legal assistance to citizens of the Republic of Belarus, foreign citizens, and stateless persons is provided at the expense of the bar associations:
- claimants – when drafting applications and conducting cases in courts of first instance related to labor relations, recovery of alimony, deprivation of parental rights;
- veterans and disabled persons of the Great Patriotic War, disabled persons of combat operations in the territory of other states – when providing oral consultations on issues not related to entrepreneurial activities;
- citizens – when drafting applications for establishing the fact of receiving wages for a specific period in a certain amount for the purpose of assigning pensions, for recognizing a citizen as having limited legal capacity or incapacitated;
- disabled persons of Group I and II – when providing oral consultations that do not require familiarization with documents;
- low-income single parents raising a child under the age of eighteen, parents (adoptive parents) in large families – when providing oral consultations that do not require familiarization with documents;
- minors – in their interests;
- parents (adoptive parents, guardians, custodians) of minors – in the interests of their minor children;
- pensioners and disabled persons residing (living) in social service institutions providing inpatient social services, as well as legal representatives of citizens recognized by the court as incapacitated – when providing consultations on issues related to ensuring and protecting the rights and legitimate interests of the said citizens;
- pregnant women – when providing oral consultations on issues related to childbirth;
- other categories of citizens – by decision of the Bar Association.
