Organization of Training and Employment by Direction of Labor, Employment and Social Protection Authorities

In accordance with the Law of the Republic of Belarus "On Population Employment", citizens have the right to free consultation and free information from labor, employment and social protection authorities for the purpose of choosing a profession, occupation, and training opportunities.

Unemployed citizens and citizens seeking employment have the right to free vocational guidance.

Vocational guidance for unemployed citizens and citizens seeking employment is carried out by labor, employment and social protection authorities to provide practical assistance in choosing a profession, changing occupation, and improving qualifications, taking into account citizens' abilities, aptitudes, professional interests, and labor market needs.

Unemployed citizens have the right to free training at the direction of the employment service. Citizens seeking employment may also receive free training from among:

  • those caring for a child under the age of three (mother (stepmother), father (stepfather), adoptive parent, guardian) (except for those on childcare leave until the child reaches the age of three);
  • those caring for a child with a disability under the age of 18;
  • citizens receiving benefits for a child under the age of 18 infected with the human immunodeficiency virus.

In which cases training is carried out by labor, employment and social protection authorities

  • it is impossible to find suitable work due to the unemployed person's lack of necessary training for the employee position (worker's profession), specialty, qualification;
  • it is necessary to change the employee position (worker's profession), specialty, qualification due to the lack of work corresponding to the unemployed person's professional skills;
  • the unemployed person has lost the ability to perform work in the previously acquired employee position (worker's profession), specialty, qualification, or medical contraindications for its performance have arisen.

What are the types of training for unemployed persons

  • Training for unemployed persons is carried out according to the following adult continuing education programs:
  • educational program for advanced training of managers and specialists;
  • educational program for retraining of managers and specialists with higher education;
  • educational program for retraining of managers and specialists with secondary vocational education;
  • educational program for advanced training of workers (employees);
  • educational program for retraining of workers (employees);
  • educational program for vocational training of workers (employees);
  • educational program for training drivers of mechanical vehicles, self-propelled machines;
  • educational program for retraining of drivers of mechanical vehicles, self-propelled machines;
  • educational program for advanced training of drivers of mechanical vehicles, self-propelled machines;
  • educational program for training courses (lectures, thematic seminars, workshops, trainings, officer courses, and other types of training courses) (hereinafter referred to as the training course educational program).

Procedure for organizing training for unemployed persons

  • Education is provided by adult continuing education institutions, other educational institutions implementing adult continuing education programs, other organizations, and individual entrepreneurs who are legally authorized to conduct educational activities.
  • The training of unemployed individuals, as directed by labor, employment, and social protection authorities, is carried out based on an agreement concluded by the labor, employment, and social protection authority with an educational institution, other organization, or individual entrepreneur, following a procurement procedure in accordance with the legislation on public procurement.
  • The organization of training is carried out in full-time (daytime) education, and for educational programs, professional development, retraining of managerial staff and specialists, and training courses, it is carried out in distance learning format under the conditions stipulated by the legislation on education.
  • Unemployed individuals directed for training to another locality, as well as unemployed individuals with disabilities who use technical means of social rehabilitation for mobility, regardless of their place of residence (place of stay), are provided with dormitory accommodation (part thereof) or other housing during the training period by the educational institution, other organization, or individual entrepreneur, if available.
  • Training directed by labor, employment, and social protection authorities is carried out within the framework of a trilateral agreement. The acquisition of the content of educational programs for training courses (lectures, thematic seminars, workshops, training sessions, officer courses, and other types of training courses) is carried out within the framework of a bilateral agreement.
  • Unemployed individuals directed for training by the labor, employment, and social protection authority retain their right to unemployment benefits.

If the training period exceeds the period of unemployment benefit payment established by paragraphs 1 or 2 of Article 18 of the Law "On Employment of the Population," the payment of unemployment benefits is extended for the duration of the training.

One of the following agreements is concluded with an unemployed individual directed for training:

  • agreement on training and employment between the labor, employment and social protection authority, the unemployed person, and the employer (trilateral agreement) – in cases of referral of an unemployed person for vocational training, specialization, or qualification corresponding to the right to operate a mechanical vehicle or self-propelled machine;
  • agreement on training between the labor, employment and social protection authority and the unemployed person (bilateral agreement) – in case of referral of an unemployed person for the acquisition of educational programs of training courses (lectures, thematic seminars, workshops, training sessions, officer courses, and other types of training courses).

A trilateral agreement is considered concluded from the date of its signing by all parties before the start of training and is valid until the end of the mandatory employment period, if such employment is stipulated by the trilateral agreement. The mandatory employment period is calculated from the date the employment contract takes effect.

For unemployed persons who have completed the educational programs for training drivers of mechanical vehicles and self-propelled machines; retraining of drivers of mechanical vehicles and self-propelled machines; upgrading the qualifications of drivers of mechanical vehicles and self-propelled machines; educational programs for vocational training of workers (employees), retraining of workers (employees) in professions for which the tariff and qualification characteristics provide for the operation of wheeled tractors and self-propelled machines, as well as for professions with a training period of 6 months or more, the mandatory employment period must be at least 1 year.

MANDATORY EMPLOYMENT

Unemployed persons who have completed the full course of training are obliged to report to the labor, employment and social protection authority that referred them for training and submit their educational document (training document) within 1 working day following the date of its issuance; if the training is completed in another locality, within 2 working days.

Unemployed individuals who have completed educational programs for training drivers of motor vehicles, self-propelled machines; retraining of drivers of motor vehicles, self-propelled machines; advanced training of drivers of motor vehicles, self-propelled machines, are obliged to appear at the labor, employment, and social protection authority that sent them for training and present a document confirming the right to operate a motor vehicle, self-propelled machine within 1 working day following the day of its issuance, but no later than 3 months from the date of obtaining the certificate of training, retraining, advanced training of drivers of motor vehicles, self-propelled machines.

The labor, employment, and social protection authority shall issue a job referral on the day the unemployed individual presents the document on education (document on training), and the document confirming the right to operate a motor vehicle or self-propelled machine.

Unemployed individuals are obliged to appear at the employer for employment no later than the working day following the day of receiving the job referral, and to work the mandatory work period specified in the tripartite agreement in accordance with the acquired specialty and assigned qualification, if such work is provided for by the tripartite agreement.

The employer, within 2 working days from the date of issuing the order to hire a citizen employed in the acquired specialty and assigned qualification under the terms of a tripartite agreement, shall send a copy of such order to the labor, employment, and social protection authority.

Unemployed individuals directed for training to another locality shall be compensated for expenses (upon presentation of supporting documents for the actual training period)

    • for travel to and from the place of study (before the start and after the end of studies, or upon daily return of the unemployed person to their place of residence (stay) by public railway transport on regional and interregional economy class trains, by public road transport of suburban or intercity regular service) - at actual costs upon presentation by the unemployed person of the original supporting document for payment of travel (travel ticket);
    • for travel to and from the place of practical training (before the start and after the end of practical training, or upon daily return of the unemployed person to their place of residence (stay) by public railway transport on regional and interregional economy class trains, by public road transport of suburban or intercity regular service) - at actual costs upon presentation by the unemployed person of the original supporting document for payment of travel (travel ticket);
    • for renting residential premises (part thereof) if it is impossible to provide dormitory accommodation or other residential premises by the educational institution, other organization, or individual entrepreneur for the period of study - at actual expenses based on supporting documents, not exceeding the cost of a first-category room in a hotel in the locality (place) where the unemployed person is studying, or a nearby locality if there is no hotel in the locality (place) of study of the unemployed person, including when residing in other residential premises.

    Reimbursement of expenses is carried out by transferring funds to the current (settlement) bank account of an individual with basic service conditions, opened by that person in a bank, within 5 business days from the date of submission of supporting documents for the actual period of study.
